Abstract

The misuse of social media and technology is an emerging threat to adolescents. The court systems are being forced to address the legality and fine line of social media use and the First Amendment rights of those involved. This research study is a legal analysis of cyberbullying with sexting cases primarily in North Carolina. The researcher will examine how cyberbullying with sexting case law in North Carolina addresses students’ First Amendment free speech rights. In addition, a glimpse into these cases revealed the frequency with which these cases are decided under child pornography laws. The cases were primarily limited to cyberbullying with sexting.
